In this case, the petitioner is seeking anticipatory bail in connection with Turkauliya (Banjaria) P.S. Case No.537 of 2019, registered for the offence under Sections 363 and 366(A) of the Indian Penal Code.

The father of the victim has made complaint that unknown person has kidnapped his daughter. However, the victim girl, in her statement recorded under Section 164 of the Cr.P.C., has stated that at the time of purchasing a Sim Card she met with the petitioner and whereafter they frequently talked with each other and petitioner has put pressure on her to do a job, whereupon, he has given offer to go to Kuwait country, but

In the meantime, the family members started searching and made a call to her and threatened the petitioner. Thereafter, the petitioner took her to Varanasi and later on, took her to Lukhnow and finally, took her to Motihari. Considering the statement of the victim girl, let the petitioner, above-named, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, East Champaran, Motihari, in connection with Turkauliya (Banjaria) P.S. Case no. 537 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
