The petitioner has filed the instant application for grant of anticipatory bail apprehending his arrest in a case registered for the offence under sections 147, 148, 149, 353, 307, 100, 332 and 333 of the IPC and Section 27 of the Arms Act.
Allegation as per the FIR is of the accused persons having fired on the police party.
It is submitted by learned counsel for the petitioner that no injury has been caused to any of the police personnel. It is further submitted that petitioner is not named in the FIR rather his name transpired on confessional statement of one Gorelal Mahto who has been enlarged on regular bail subsequently. It is further submitted that the case of the petitioner also stands on similar footing to the other co-accused who have been enlarged on bail, some of the orders of whom have been brought on record is Annexure-2 to this petition.

No.80104 of 2019(3) dt.10-12-2019 2/2 Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the court is inclined to enlarge the petitioner on bail. The petitioner above named, in the event of his arrest or surrender in the court below within a period of six weeks from today in connection with Sikandra P.S. Case No.169 of 2017 is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Ist Class, Jamui subject to the conditions as laid down in section 438(2) of Criminal Procedure Code.
