Petitioner is accused in connection with Kalyanpur P.S. Case No. 35 of 2019 registered under Sections 363, 366(A)/34 of the I.P.C.

Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in this case. The victim in her statement recorded under section 164 Cr. P.C. clearly stated that she was taken to Samastipur along with two others and thereafter, Punjab by train where she stayed for fifteen days with the petitioner, but the victim did not raise hulla against the petitioner and also lived there for two months with owner of the house but she did not complain about the alleged

Patna High Court CR. MISC. No.76926 of 2019(3) dt.05-03-2020 2/2 incident in the police station. It is also submitted that in the medical examination, the aged of the victim is assessed as 17-18 years, major. Further submission is that petitioner is in custody since 30.05.2019.

Having considered the above facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Samastipur in connection with Kalyanpur P.S. Case No. 35 of 2019.
