2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 80, 238 and 3(5) of B.N.S.

3. The case of the prosecution is that the deceased was married to one Teeju Sahani on 31.01.2022. It is further alleged that she was subjected to cruelty on account of non-fulfillment of dowry demand. It is also alleged that the petitioner was having an ill eye over the deceased which was objected by the deceased due to which, she was being assaulted. On 04.05.2025, the villagers told the informant that the deceased was being

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that the petitioner is brother-in-law of the deceased and he is separate from the mess and residence of the deceased as well as from her husband. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 05.08.2025.

5. Learned APP appearing for the State and learned counsel for the informant have vehemently opposed the prayer of regular bail. Learned counsel for the informant has submitted that allegation against this petitioner that he was having ill eye on the deceased and was pressurizing her for establishing physical relationship.

From perusal of the order the learned trial court, it is clear that deceased has sustained multiple abrasion all over chest and gluteal region and the doctor opined that the deceased died due to hemorrhage, comma and shock due to above noted injury caused with hard and blunt substance which are antemortem in nature. This much is clear that the death is not natural

7. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Karja P.S. Case No. 114 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Court No. 6 Muzaffarpur (West).
