Petitioner apprehends arrest in a case registered for the offences punishable under Sections 323, 406 and other allied sections of the Indian Penal Code.
Prosecution's case in short is that the petitioner got the construction work done by the opposite party no.2 and did not pay the labour cost and on demand of the same he assaulted him.
Learned counsel appearing for the petitioner submits that the petitioner has falsely been implicated in this case. Petitioner is the head master of the school and in fact the construction work in question had not been allotted to the opposite party no.2 by the Vidyalaya Siksha Samiti and being annoyed, this false case has been instituted. Petitioner
Patna High Court CR. MISC. No.77294 of 2019(4) dt.27-02-2020 2/2 has got no criminal antecedent. It is also submitted that the petitioner has also filed an appeal before the Additional collector, Araria against order dated 20.10.2017, passed by the SDM, Forbesganj under the Minimum Wages Act.
Learned counsel for the opposite party no.2 opposes the prayer for bail.
Considering the facts of the case, provisional bail allowed to the petitioner vide order dated 28.11.2019 is hereby confirmed on the conditions given in the said order. (Prabhat Kumar Singh, J) Shashi U T
