====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 09-09-2025 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Sarai P.S. Case No. 314 of 2021 dated 07.12.2021 registered for the offence punishable under Sections 341, 307 and 302 read with Section 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have assaulted and opened fire upon the son, namely, Banti and the nephew, namely, Vikky Kumar, of the informant. Due to which the son of the informant sustained injury and his nephew died during the course of treatment.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. As per letter no. 61 dated 23.08.2025, it is mentioned that there are eight charge-sheeted witnesses in this case out of which one witness has been examined. The other co-accused person has already been granted regular bail by this Court vide order dated 19.07.2023 passed in Cr. Misc. No. 40815 of 2023. The petitioner has four criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 24.01.2022.

5. Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Vaishali at Hajipur in connection with Sarai P.S. Case No. 314 of 2021, with following conditions:- (i) The petitioner is directed to remain physically

No.88256 of 2024(9) dt.09-09-2025 3/3 present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled. (ii) If the petitioner is found involved in similar nature of offence in future, the prosecution will be at liberty to move for cancellation of his bail bond.

(iii) The petitioner is directed to co-operate in the trial before the learned court below.
