2. The petitioner is in judicial custody in connection with Session Trail Reg. No. 326 of 2025 arising out of Sonhan P.S. Case No. 139 of 2025 for the offence punishable under Sections 80, 3(5) of Bhartiya Nayay Sanhita, 2023 Act lodged on 18.07.2025 by the informant, Abhimanyu Singh.
3. As per the prosecution story, the informant alleged that the daughter was married to Raghubar Bind but always tortured for dowry for which a Panchayati also took place. The allegation is that since the lady was not having a child, was abused and on 18.07.2025, came the news about her death. This led to the FIR.
4. Learned counsel for the petitioner has taken this
Patna High Court CR. MISC. No.82464 of 2025(2) dt.03-12-2025 2/3 Court to the learned Sessions Judge order to show that the cause of death has been recorded as asphyxia due to hanging. The submission is that the petitioner is mother-in-law, living separately having no role to play.
4. Learned APP opposes the prayer.
5. Taking into account the submissions of the parties as also that the petitioner is a lady, has no criminal antecedent, is in custody since 19.07.2025, the cause of death has been recorded above as the case of suicide, FIR is there, she shall be facing the music, in that background, this Court is inclined to extend him the privilege of bail with conditions.
6. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Sessions Judge-IV, Kaimur at Bhabhua, in connection with Session Trail Reg. No. 326 of 2025 arising out of Sonhan P.S. Case No. 139 of 2025 subject to the following conditions: (i) one of the bailor should be the family member/relative of the petitioner who shall provide official document to show his bona fide;
(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive
Patna High Court CR. MISC. No.82464 of 2025(2) dt.03-12-2025 3/3 dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;
(iii) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(iv) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) Ravi/- U T
