Mr.Akbar Ali ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 26-11-2019 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Pranpur P.S. Case No. 120 of 2018 for the offence registered under Sections 392 and 120(B) of the Indian Penal Code. The allegation is regarding unknown miscreants having snatched the bag of the informant containing cash of Rs. 1, 16,911/- as also they are stated to have taken away the mobile of the informant.

The learned counsel for the petitioners submits that neither any recovery has been made from the possession of the petitioners nor there is any material on record to suggest their complicity in the alleged crime. However, it is submitted that on account of the criminal antecedents of the petitioner herein, the

Patna High Court CR. MISC. No.75629 of 2019(2) dt.26-11-2019 2/2 petitioners are ready to abide by whatever conditions which may be imposed by this Court for the purposes of grant of anticipatory bail.

Having regard to the facts and circumstances of the case, the petitioners, above named, are directed to be released on anticipatory bail in the event of their arrest/surrender before the court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Katihar, District-Katihar in connection with Pranpur P.S. Case No. 120 of 2018 subject to the conditions as stipulated under Section 438(2) of the Code of Criminal Procedure. It is needless to state that the petitioners would mark their presence before the Officer-In-Charge of the concerned Police Station at 10: A.M. on each and every Monday of the month and on account of their failure on two consecutive occasions to mark their attendance, the present privilege of anticipatory bail shall stand cancelled automatically and the petitioners shall be taken into custody forthwith.
