The petitioners seek bail in Bypass P.S.Case No.110 of 2018 registered for the offences under Sections 379 of the Indian Penal Code.

Allegation as per the F.I.R. is that the informant boarded the tempo in which there were four persons from before and when he got down his pocket was cut by pocket mar and Rs.1/- lac was taken out from his pocket. Later on, it appears from the impugned order that it came to know that pocket mars were arrested and the informant identified the petitioners.

Submission on behalf of the learned counsel for the petitioners is that there is delay of three months in lodging of the F.I.R. and further more they are accused in six other cases but in

Patna High Court Cr.Misc. No.61697 of 2018 (3) dt.19-11-2018 2/2 five cases they are on bail. Nothing has been recovered from their possession and they are in jail custody for six months. Heard the learned A.P.P. also who opposed the prayer for bail of the petitioners.

Having heard both sides and in view of the facts and circumstances of the case, stated above, at this stage, I am not inclined to grant bail to the petitioners. Prayer for bail of the petitioners is rejected.

However, once charge is framed, the petitioners will be at liberty to renew his prayer for bail.

This application is, accordingly, dismissed.
