2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 20, 22, 50 of the NDPS Act.

3. As per the prosecution case, 263.67 kg of ganja has been recovered from the maize field and co-accused person namely Sonu Kumar, was apprehended on the spot and disclosed the name of petitioner, as his accomplice.

4. It is submitted on behalf of the petitioner that nothing has been recovered from conscious possession of this petitioner. Name of petitioner transpired in this case on the basis of confessional statement of co-accused Sonu Kumar who was apprehended on the spot. Petitioner claims clean antecedent.

5. Counsel for State vehemently opposed the prayer for bail and submitted that there is recovery of huge quantity of contravened article (ganja) and the co-accused has admitted the involvement of this petitioner in the alleged occurrence.

6. Considering the huge quantity of recovery of contravened article and the petitioner has been named in this case on the basis of confessional statement of co-accused Sonu Kumar, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.
