Petitioner apprehends arrest in connection with Nabinagar P.S. Case No. 68 of 2018 registered for the offence punishable under sections 379, 420 of the Indian Penal Code, sections 4(1) and 4(1A) of Mines and Minerals (Development and Regulation) Act, 1957 and sections 26A, 27 and 40 of the Bihar Minor and Minerals Concession Rules, 1972. Learned counsel appearing for the petitioner submits that petitioner has falsely been implicated in this case. As a matter of fact, petitioner has already deposited the ownership fee through demand draft as contained in Annexure-2 payment of which has been acknowledged by the Mineral Development Officer, Aurangabad vide Annexure-3. Petitioner

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, I, Aurangabad in connection with Nabinagar P.S. Case No. 68 of 2018 subject to the conditions laid down under section 438(2) Cr.P.C.
