Petitioner seeks bail in Bikramganj P.S. Case No. 204/2014, registered for the offences punishable under Section 364 and 34 of the Indian Penal Code.

Informant alleged that his brother had gone with cash Rs. 31,000/- to purchase buffalo along with co-villagers Guddu Ram, Ashok Yadav (petitioner) and Surendra Ram. All the persons returned after 02 to 03 days, but his brother did not return. Informant suspected that they took cash from his brother and killed him.

It has been submitted that petitioner has falsely been implicated in this case. There is no evidence against the petitioner which shows his involvement in murder of his brother. Only suspicion is raised against the petitioner. Petitioner and Informant

Petitioner has no criminal antecedent. He is in custody since 18.07.2018.

Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Bikramganj, Rohtas in connection with Bikramganj P.S. Case No. 204/2014, subject to the conditions: (1.) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2.) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court.

(3.) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
