The petitioner seeks bail in Punaura P.S. Case No.91 of 2019, registered under Sections 385 and 34 of the Indian Penal Code and 66 (C) of the I.T. Act.

The informant alleged that his daughter and the petitioner were studying in a coaching institute. The petitioner tried to outrage the modesty of the daughter of the informant for which Sitamarhi P.S. Case No.700 of 2018 was registered under Sections 376, 511, 385 and 506 of the Indian Penal Code and Section 66(C) of the I.T. Act. It is further alleged that the petitioner and his relatives were exerting pressure and also

Patna High Court CR. MISC. No.78761 of 2019(4) dt.27-05-2020 2/2 ringing the victim on mobile to withdraw the case. It is further alleged that the petitioner and others uploaded the obscene photo of the daughter of the informant on social media and demanded Rs.5,00,000/- as ransom.

Learned counsel for the petitioner submits that no photograph was obtained from any social media. The petitioner never demanded any extortion from the informant. The petitioner is in jail since 02.06.2019. The petitioner has already remained in jail for about a year.

Taking into consideration the facts and nature of allegations made against the petitioner and the fact that the petitioner has already remained in jail for about a year, petitioner, namely, Ritesh Kumar is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sitamarhi in connection with Punaura P.S. Case No.91 of 2019.
