2. The petitioner seeks regular bail in connection with Banke Bazar P.S. Case No. 66 of 2025 registered for the offence under Section(s) 108, 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, the allegation against the petitioner is that he had illicit relationship with another woman and when his wife Sonam Devi objected the same, the petitioner is alleged to have administered her poisonous substance.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 30.05.2025. He further submits

Patna High Court CR. MISC. No.82064 of 2025(2) dt.23-12-2025 2/2 that no external injury was found on the body of the deceased and the deceased had committed suicide which is apparent from the blue mark present on the nail of the deceased. .

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Sherghati at Gaya/concerned Court below in connection with Banke Bazar P.S. Case No. 66 of 2025.
