2. Petitioner apprehends his arrest in connection with Bairgania P.S. Case No. 198 of 2024, registered for the offence punishable u/s 318(4) of the B.N.S., 2023 and Section 13 of the Foreign Exchange Management Act, 1999, pending in the court of learned CJM, Sitamarhi.

3. Learned counsel submits that petitioner has been granted the benefit of Section 41A, but he could not enjoy the same as he had to attend marriage in his family.

4. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

5. Permission is granted.

6. Accordingly, this application is dismissed as withdrawn.

7. However, if the petitioner surrenders before the learned Court below within six weeks from today and seeks regular bail, the learned Court below shall pass order on the same day in accordance with law without being prejudiced by this order considering the fact that charge sheet has been submitted against the petitioner.
