2. The petitioner seeks bail in connection with Paliganj P.S. Case No. 280 of 2022 registered for the offence punishable under Sections 304B/34 of the Indian Penal Code.

3. The petitioner is the husband of the deceased.

4. As per the prosecution case, the deceased has been killed by the petitioner and other co-accused persons. It has further been alleged that earlier six month pre-mature baby was born to the deceased was also killed.

5. Learned counsel for the petitioner submits that baby was pre-mature baby, the baby died and the deceased has not been killed she has also died. He is in custody since 29.08.2022.

6. Learned counsel for the petitioner submits that only one witness has been examined.

7. Considering the period of custody and the delay in trial, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge VI, Danapur, Patna in connection with Paliganj P.S. Case No. 280 of 2022.

9. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed in the trial. Noncompliance of the condition will result in cancellation of the bail bonds of the petitioner.
