The petitioner apprehends his arrest in connection with Kudhani P.S. Case No. 632/2019 registered for the offense punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and only on suspicion that the alleged recovery from the bushes behind the Gumti of the petitioner is made and the petitioner has been named in connection with the present case. It is thus submitted that no recovery having been made from the conscious possession of the petitioner, as such, he may be extended the privilege of prearrest bail.

No.76515 of 2019(2) dt.21-01-2020 2/2 In view of the aforementioned facts and circumstances, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur, in connection with Kudhani P.S. Case No. 632 of 2019, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
