JUSTICE SHIVAJI PANDEY ORAL ORDER 18-05-2020 Heard the parties through video conferencing in view of the total lock-down on account of COVID-19 pandemic. In this case, the petitioner is seeking regular bail in connection with Kudra P.S. Case No. 324 of 2019 registered for offence punishable under section 30 (a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

On secret information, the police has intercepted a motor cycle bearing Registration no. BR24Y1826 TVS Victor and a splender plus silver motor cycle bearing Registration no.BR458127 and from there three bags were seized containing 90 + 171 + 98 bottles of liquor, each containing 200 ml., total comes to 71.800 litres.

Learned counsel for the petitioner submits that the petitioner is in custody since 18.10.2019.

Case No. 324 of 2019, subject to the condition that if the petitioner is found involved in similar type of case in future, the prosecution will be at liberty to file an application for cancellation of his bail bond.
