The petitioners are apprehending their arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioners submits that there is no recovery from the conscious possession of the petitioners rather 26.250 litres of foreign liquor has been recovered from the Tempo. He submits that the name of the petitioners has come in the present case on the confessional statement of coaccused Manoj Kumar. He further submits that petitioners have no criminal antecedent as stated in para-3 of the bail petition.

No.83672 of 2019(3) dt.13-02-2020 2/2 In the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioners, subject to deposit of Rs. 2000/- in the Juvenile Justice Fund of the State Social Welfare Department and on deposit of the aforesaid amount, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Excise Judge, Gaya in connection with Tekari Police Station Case No. 81 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
