JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-09-2019 The learned counsel for the petitioners herein seek a direction upon the respondent Nagar Parishad, Danapur to revise the pension of the petitioners after adding 139 per cent Dearness Allowance and Medical Allowance to their pension. It is further prayed that leave encashment of 300 days be paid to the petitioners herein. As far as the petitioners no. 1 & 2 are concerned, it is prayed that the differential amount of gratuity and other retiral dues on account of them being taken back into service for a further period of about two years be also granted

The learned counsel for the petitioner submits that the present writ petition may be disposed off with liberty to the petitioners to approach the respondent -Municipality seeking redressal of their grievance before them inasmuch as similarly situated persons have already been granted such relief. Accordingly, liberty is granted to the petitioners to approach the respondent no. 4 by filing appropriate claim/representation within a period of four weeks from today whereafter the respondent no. 4 shall dispose off the same by a reasoned and legal order within a period of eight weeks thereafter and in case any dues are found payable, the same would be paid within a period of eight weeks therefrom. The writ petition stands disposed off on the aforesaid terms.
