The petitioner seeks regular bail in connection with Kateya PS Cae No.359/19 registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016 .

Allegation against the petitioner is about recovery of 62 ltrs. of liquor from the motorcycle of the petitioner and the petitioner was arrested.

Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case, motorcycle does not belong to the petitioner and he has been arrested only on suspicion and he is in custody for two months. Charge sheet has already been submitted as such there is no chance of

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District and Sessions Judge 2nd cum Special Judge, Excise, Gopalganj in connection with Kateya P.S.Case No.359 of 2019. With the aforesaid observation, this application is allowed.
