JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 18-12-2019 Heard learned counsel for the petitioner, learned counsel for the informant and the learned A.P.P. for the State. The petitioner is accused in connection with Patepur P.S. Case No. 201 of 2018, registered under Sections 302 and 201/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that it would appear from the FIR that on seeing the dead body of unknown male, Patepur P.S. Case No. 201 of 2018 was instituted against unknown on the basis of Fradbeyan of Choukidar on 21.11.2018 and thereafter, the dead body was identified and taken by Shambhu Kumar Sukla, brother of deceased, on 22.11.2018 and on next date, he gave Sanha at the police station to the effect that on 20.11.2018, deceased, Amit

Patna High Court CR. MISC. No.76924 of 2019(2) dt.18-12-2019 2/2 Kumar Sukla, was called by the petitioner to give money but the deceased Amit Kumar Sukla did not return. Shambhu Kumar Sukla, brother of the deceased, raised suspicion against the petitioner having hand in murder of his brother, Amit Kumar Sukla. Further submission is that petitioner has no criminal antecedent and is in custody since 11.09.2019. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-XIV, Vaishali at Hajipur, in connection with Patepur P.S. Case No. 201 of 2018. Out of two sureties, one surety must be the close relative of the petitioner.
