Petitioner apprehends his arrest in a case registered for the offence punishable under section 379 of the Indian Penal Code.

The prosecution case, in brief, is that on 19.06.2019 in the night Blero vehicle was stolen from the door of the driver of the informant. It has further alleged that the petitioner including other co-accused persons were seen wandering the vehicle at the time of tilak.

It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in this case on the basis of suspicion. It has further submitted that nothing incriminating material has been recovered from the conscious possession of the petitioner and he has not committed any offence as alleged and also nobody has seen the petitioner to

Patna High Court CR. MISC. No.76843 of 2019(2) dt.14-02-2020 2/2 commit theft of vehicle. The petitioner has no criminal antecedent.

Considering the aforesaid facts and circumstances as well as nature of accusation, in the event of his arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Saran at Chapra in connection with Manjhi P.S. Case No. 179 of 2019, on the following conditions:-

(1) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the Court below.

(2) If the petitioner tampers with the evidence or the witnesses, in that case the prosecution will be at liberty to move for cancellation of bail.
