The petitioner apprehends her arrest in connection with Runisaidpur P.S. Case no. 295 of 2019, registered under Section 7 of the E.C. Act.

The accusation is that petitioner being the Block Supply Officer, Runisaidpur received information about seizing of the tractor attached with the trailer loaded with bags of rice while driver of the tractor succeeded to flee away. Thereafter, villagers claimed that the said bags of rice belong to the petitioner, which was being transported for black marketing. Thereafter, fair price shop of the petitioner was searched, where 31 bags of wheat 15.50 quintal were found while no bags of

Patna High Court CR. MISC. No.76956 of 2019(2) dt.27-11-2019 2/2 rice was found there while according to the stock register at least 21.25 quintal rice should be there.

Learned counsel for the petitioner submits that after lodging of the present case, the license of fair price shop of the petitioner has been cancelled. Moreover, Raj Kishore Purvey has claimed the seized bags of rice loaded on the tractor saying that rice was purchased from Shivam Rice Mills, Narma Tola, P.O. Kanti, P.S. Minapur, District-Muzaffarpur, which would appear from Annexure-2. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M. Sadar, Sitamarhi in connection with Runisaidpur P.S. Case No. 295 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
