2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 303(2), 318(4), 336(3) and 3(5) of the BNS.
3. The case of the prosecution in short is that the petitioner was found with a bike and when he was asked regarding the documents of the bike, he could not show the documents and when the same was verified with the HHD device, it was discovered that the bike is registered in the name of Lalti Devi. After contacting Lalti Devi, the informant came to know that Garkha P.S. Case No. 631 of 2025 has been filed regarding the theft of the said bike. It is further alleged that the petitioner disclosed that he has purchased the bike from one Sahani who is resident of East Champaran whose mobile no. is 9528775177 but

4. Learned counsel for the petitioner has submitted that the petitioner has purchased the bike from one Sahani who is resident of East Champaran. Learned counsel has further submitted that the petitioner has no concern in theft of that bike. Learned counsel has lastly submitted that the petitioner is languishing in judicial custody since 26.08.2025.
5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner and has submitted that the petitioner is having criminal antecedent of one case.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sangrampur P.S. Case No. 332 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, East Champaran, Motihari.
