JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-12-2019 The petitioner seeks regular bail in connection with Saharsa P.S. Case No. 311 of 2019, corresponding to POCSO Case No. 11/2019, registered for offences punishable under Sections 376/34 of the Indian Penal Code and Section 6 of POCSO Act.

Allegation as per F.I.R. is that minor sister in law of the informant, was taken away by the petitioner and others and, thereafter, she was subjected to rape.

It has been submitted on behalf of the petitioner that the main accused, namely, Madhav Kumar has already bee enlarged on bail as he was declared Juvenile and petitioner has falsely been implicated in this case and has been in judicial custody since 02.10.2019.

Learned A.P.P. opposed the prayer for bail.

Patna High Court CR. MISC. No.76639 of 2019(2) dt.11-12-2019 2/2 Having heard both sides, considering the facts and circumstances of the case and the nature of allegation, I am not inclined to enlarge the petitioner on bail. However, learned Trial Court is directed to expedite the Trial.

This application is accordingly dismissed.
