2. Petitioner seeks bail, who is in custody since 19.05.2022, in connection with N.D.P.S. Case No. 49 of 2022 arising out of N.C.B. Case No. 09 of 2022 registered for the offences punishable under Sections 8(c), 21(b), 25 and 29 of the N.D.P.S. Act.
3. Recovery is of 50 grams of Heroin and 01 Kg. of brown coloured substance.
4. Earlier the bail petition of the petitioner was rejected vide order dated 10.05.2023 passed in Cr. Misc.
Patna High Court CR. MISC. No.87071 of 2024(4) dt.17-01-2025 2/3 No. 56163 of 2022 and thereafter the petitioner has moved before the Hon'ble Apex Court for grant of regular bail in S.C.A. No. 9024 of 2023 and the same was dismissed vide order dated 03.11.2023.

From perusal of the F.I.R. it appears that 50 grams of Heroin and 01 Kg. of Brown colored substance was recovered from co-accused person and the petitioner has been made accused in the present case on the basis of CDR analysis and confessional statement of co-accused persons namely Upendra Ram and Ravi Ranjan Kumar and apart from that the FSL report confirms that the recovered contraband is Heroin.
6. Vide order dated 13.12.2024, a report was called for with regard to the present stage of the trial. The report of the learned Trial Court dated 20.12.2024 reveals that out of five chargesheeted, three witnesses have already been examined and the case is pending for the examination of rest two prosecution witnesses.
7. In view of the report of the learned Trial court, I am not inclined to enlarge the petitioner on bail in connection with N.D.P.S. Case No. 49 of 2022 arising out of N.C.B. Case No. 09 of 2022 pending in the Court of learned Ist Additional Sessions Judge, Bhojpur at Ara.

8. Prayer is refused.
9. However, the learned Trial Court is directed to expedite the trial and conclude the same at the earliest. (Rajesh Kumar Verma, J) Ibrar//- U T
