The petitioner is the wife of the opposite party, namely, Sadan Kumar Verma who has filed this application for transfer of Matrimonial Case No. 835 of 2017 from the Principal Judge, Family Court, Patna to the Principal Judge, Family Court, Chapra.

It is submitted that the petitioner is a lonely lady having no support from her family and she is also having no income to meet her legal expenses and travel from Chapra to Patna and pursue the matrimonial case at Patna from Chapra. The learned counsel for the opposite party has filed a counter affidavit and submits that the petitioner is leading an adulterous life and, therefore, this application should be dismissed.

Considered the submission of the parties.

Patna High Court MJC No.3380 of 2018(5) dt.11-11-2022 2/2 Considering the fact that the petitioner is a lady and she will have difficulty in going to Patna from Chapra, this application is allowed.

The transferee Court will consider the every aspect of the matter while deciding the main case.

With the aforesaid observation and direction this application is allowed.
