2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 420/34 of the Indian Penal Code and Sections 67 & 67(a) of the I.T. Act.

3. According to the prosecution case, the petitioner is accused of making the obscene photo of the informant viral on social media along with co-accused Ankit Kumar with an intention to lower down her dignity.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. It is also submitted vide para 12 of the petition that one Arpit Raj and informant were sent to judicial custody on 18.5.2022 in connection with

Patna High Court CR. MISC. No.671 of 2024(2) dt.16-01-2024 2/2 Danapur P.S. Case No. 409 of 2022 in a matter related to demand of Rs. 25 lakh in exchange of settlement of the case from father of the co-accused Ankit Kumar who is also an accused in the present case along with this petitioner. Due to this reason, the informant made false and fabricated story and implicated the petitioner. The petitioner has got no criminal antecedent and he is languishing in judicial custody since 25.9.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody period, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Danapur P.S. Case No. 83 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-I, Danapur at Patna.
