The petitioner has prayed for bail in connection with Kalyanpur P.S. Excise P.S. Case No. 469 of 2019 registered for the offence punishable under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per allegation in the prosecution report, 16.140 litres of IMFL is said to have been recovered from just outside the house and inside of the boundary-wall of the petitioner. From perusal of the record of the case, it transpires that it is the case of the petitioner that no recovery has taken place from the possession of the petitioner. He has no concern with the alleged recovered liquor, petitioner is in custody since

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge-II-cum-Special Judge, Excise Act, Samastipur in connection with Kalyanpur P.S. Excise P.S. Case No. 469 of 2019.
