JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-01-2020 Petitioner seeks bail in anticipation of his arrest in connection with Kudhani P.S. Case No. 424 of 2019 registered for the offences punishable under Sections 399, 402, 34 of the Indian Penal Code and Sections 25(1-B)(a), 26 and 35 of the Arms Act.

As per FIR one accused was arrested, who disclosed the name of petitioner and others that they were preparing for committing dacoity in the Bank.

Submission of learned counsel for the petitioner is that except confessional statement there is no recovery from him and he has no criminal antecedent and he is ready to co-operate in the investigation.

Heard learned APP also.

In view of above facts and circumstances, let

Patna High Court CR. MISC. No.76908 of 2019(2) dt.20-01-2020 2/2 petitioner, in the event of surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, West, Muzaffarpur, in connection with Kudhani P.S. Case No. 424 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition that he has to appear before police after his release and co-operate in the investigation, otherwise his bail bonds shall be cancelled.
