The present petition has been filed for restoration of a

Patna High Court MJC No.3847 of 2025(2) dt.28-11-2025 2/2 petition bearing CWJC No. 18903 of 2024, which has stood dismissed for default on account of non-compliance of the peremptory order dated18.12.2024.

The Ld. Counsel for the petitioners has submitted that on account of wrong calculation of the time period during which the defects pointed out by the Registry were to be removed, the defect could not be removed within time, however the defects have already been removed, thus a sympathetic view be taken and the aforesaid petition be restored to its original file. 4.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioners as also considering the averments made in the present petition, I deem it fit and appropriate to direct for restoration of the aforesaid petition bearing CWJC No. 18903 of 2024 to its original file, however subject to the Registry verifying as to whether the defects have stood removed or not. 5.

The present petition stands disposed off on the aforesaid terms.
