2. The petitioner apprehends his arrest in a case, registered for offence punishable under Sections 394, 411, 146, 148, 149, 341, 323, 111(C), 216(A), 342, 353, 307, 395, 412, 400, 402, 302, 120(B)/34 of the Indian Penal Code.

3. As per F.I.R., all the accused persons named in the F.I.R. participated in killing of SHO of Town Police Station, Kishanganj.

4. Petitioner is not named in the F.I.R. Name of petitioner transpired during course of investigation in the confessional statement of co-accused Md. Jakir and Chain Bano. In the statement recorded under Section 164 Cr.P.C., one witness namely Nasim Akhtar has stated that this petitioner also participated in the killing of S.H.O. Town Police Station, Kishanganj. 5. Considering the same, the prayer for anticipatory bail of petitioner is rejected.
