JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-01-2020 The petitioner seeks regular bail in connection with Raxaul P.S. Case No. 166 of 2019, registered for offences punishable under Sections 379 and 411 of the Indian Penal Code.

Prosecution case is that the petitioner was arrested while committing theft of motorcycle.

It has been submitted on behalf of the petitioner that the real fact is that the motorcycle of the petitioner dashed the informant and some scuffle took place between the parties and due to which, the petitioner has been roped in the present false case. Further submission is that he has no criminal antecedent and he has been in judicial custody for more than seven months. Heard learned A.P.P. also.

Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Raxaul, East Champaran, Motihari, in connection with Raxaul P.S. Case No. 166 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
