The petitioner seeks bail in anticipation of her arrest in connection with Sono P.S. Case No. 335 of 2017 dated 15.12.2017 instituted for the offences under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code. The petitioner is being prosecuted in this case on the basis of report of a Nodal Officer, Vigilance Department that the mark-sheet which was submitted by the petitioner for appointment on the post of Teacher was found to be forged.
Mr. Uma Kant Shukla, learned counsel for the
Patna High Court Cr.Misc. No.57857 of 2018(3) dt.11-12-2018 2/3 petitioner has submitted that the petitioner had appeared in the examination and had obtained particular percentage of marks and for that, a certificate was issued to her. That was the certificate which she had filed for the purposes of being considered for the post of Teacher and in that effort she had become successful.
It has further been submitted on behalf of the petitioner that there is nothing on record to clearly indicate that the petitioner had participated in the manufacturing or obtaining of such forged mark-sheet for the purposes of taking advantage of the same. It has further been argued that the petitioner has been removed from her employment. It is to be noted that the other educational certificates of the petitioner on inquiry were found to be genuine inquiry.
Taking into account the aforesaid facts as also the gender of the petitioner, the petitioner above-named is directed to be released on bail, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this
Patna High Court Cr.Misc. No.57857 of 2018(3) dt.11-12-2018 3/3 order, on her furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., 1, Jamui in connection with Sono P.S. Case No. 335 of 2017, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
