JUSTICE ASHUTOSH KUMAR ORAL JUDGMENT Date : 10-12-2019 The petitioner after his superannuation was engaged on an honorarium to perform his duties on the same post. However without any reason, the honorarium of the petitioner for the period 30.06.2018 to 15.06.2019 has not been paid and according to the petitioner there is no reason whatsoever for withholding such payments. Learned counsel for the petitioner has submitted that the representation before the District Magistrate, Nalanda (respondent no. 3) has also fallen on deaf ears.

Patna High Court CWJC No.24689 of 2019 dt.10-12-2019 2/3 Mr. Ojha, learned counsel for the State submits that it is really unfortunate that the petitioner has not been paid his honorarium for the period that he has worked after his superannuation. Should the petitioner make a fresh representation before the District Magistrate, Nalanda, the claim of the petitioner shall be inquired into and if it is found to be tenable, necessary orders shall be passed.

In view of the aforesaid stand of Mr. Ojha, learned counsel for the State, this Court directs the petitioner to make a fresh representation before the District Magistrate, Nalanda stating in detail the period for which his honorarium has not been paid, within a period of three weeks. On the respondent no. 3 receiving such representation, he shall dispose of the same within a period of six weeks thereafter. In the time period provided by this Court, the claim of the petitioner shall be verified by the concerned respondent and if it is found to be tenable, necessary orders shall be passed and arrangement

Patna High Court CWJC No.24689 of 2019 dt.10-12-2019 3/3 shall be made for making available to the petitioner the amount which is due to him.

With the aforesaid direction/observation, the writ petition stands disposed of.
