====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 02-12-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Petitioner seeks regular bail in connection with Bhagwanpur Hat P. S. Case No. 313 of 2025 in a case registered for the offences punishable under Sections 190, 191, 192, 126(2), 127(2), 115(2), 118(2), 109, 103, 61(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act.

3. As per F.I.R., this petitioner along with co-accused Amit Kumar assaulted Kanhaiya Singh as a result of which, he died. As per post-mortem report, deceased sustained three injuries.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Petitioner

Patna High Court CR. MISC. No.82975 of 2025(2) dt.02-12-2025 2/2 was not present at the place of occurrence and has falsely been implicated in this case due to previous enmity. Petitioner claims clean antecedent and is in custody since 11.07.2025.

5. However, learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the nature of accusation and the fact that petitioner is one of the assailants of the deceased, prayer for regular bail of the petitioner is refused.
