2. The petitioner who apprehends arrest in connection with Alinagar P.S. Case No. 33 of 2024 lodged on 13.04.2024 for the offences punishable under sections 409 and 420 of the Indian Penal Code.
3. As per the prosecution, it is alleged that the petitioner has misappropriated a government amount of 73,000/- meant for the construction of toilets. ₹
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is neither named in the F.I.R. nor has any specific

It is further submitted that the alleged amount of 73,000/- was ₹ misappropriated by the named accused, Nishant Kumar Jha, who was the then Principal of the school. However, the said amount has already been deposited by Nishant Kumar Jha. The petitioner, being an assistant teacher, merely signed the cheque as a co-signatory and had no involvement in the alleged misappropriation. It is also submitted that co-accused Nishant Kumar Jha has already been granted anticipatory bail by the learned Sessions Judge. However, it is submitted that the petitioner is an accused in one other criminal case as well.
5. Learned APP for the State opposes the prayer for bail and submits that, as per the ordersheet, the amount in question has indeed been deposited by the co-accused Nishant Kumar Jha into the account of the competent authority.

In the facts and circumstances, let the above named petitioner be released on bail, in the event of arrest or surrender before the Trial Court within a period of four weeks from today, on furnishing bail bond of ₹30000/- (thirty thousand) as mentioned in Section 2(1) (d) of the Bharatiya Nagrik Suraksha Sanhita, 2023 to the satisfaction of the learned SDJM, Benipur, Darbhanga, in connection with Alinagar P.S. Case No. 33 of
