ANJANA MISHRA ORAL ORDER 04-12-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 31.10.2019 in connection with Bahadurganj P.S. Case No.312 of 2019 giving rise to Special Case No.388 of 2019 for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner, but from the house of one Sheela Devi. It is further submitted that apart from the present case, the petitioner has been implicated in two other cases of similar nature in which he has already been extended the privilege of bail.

Considering the aforementioned facts and

No.76862 of 2019(2) dt.04-12-2019 2/2 circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge, 2nd CumSpecial Judge (Excise), Kishanganj, in connection with Bahadurganj P.S. Case No.312 of 2019 giving rise to Special Case No.388 of 2019.
