2. The petitioner seeks bail in connection with Majhauliya P.S. Case No. 246/2025 registered for the offences punishable under Sections 238/ 80/ 3(5) of the B.N.S.

3. As per the prosecution case, petitioner and others are alleged to have killed the deceased for demand of dowry.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present case. Learned counsel further submits that the deceased has committed suicide and after her death both her children are staying with the family of the petitioner. Petitioner is a man with a clean antecedent and he is in custody since 01.09.2025. The petitioner undertakes to co-operate in the case/ trial.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

6. Considering the facts and circumstances of the case, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran /concerned Court below in connection with Majhauliya P.S. Case No. 246 of 2025 subject to the condition:- (i) The court below shall verify the fact that whether the children are staying with the family of the petitioner or not, if it is found that the children are staying with the family of the petitioner then the bail bond of the petitioner shall be accepted.
