The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 302/34 of the Indian Penal Code.

Allegation against the petitioner is of assaulting the informant's son by gun shot and in the way of hospital he died. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is not named in the FIR rather the FIR is against unknown persons. The petitioner has got no criminal antecedent. The petitioner has been made accused only on suspicion. Learned counsel for the petitioner further submits that there is no specific allegation against the petitioner. The learned counsel for the informant submits that the

On perused the case diary, the Investigating Officer has mentioned in case diary that the petitioner is present at the petrol pump which was seen by CCTV footage and there is no specific allegation against the petitioner.

In the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi, in connection with Bathnaha P.S. Case No. 83 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
