The petitioner seeks bail in connection with Sessions Trial No. 912 of 2023 arising out of Naubatpur P.S. Case No. 218 of 2023 instituted for the offence under Sections 341, 323, 324, 307/34 of the Indian Penal Code and 27 of the Arms Act.

As per allegation in the FIR, petitioner and coaccused, namely, Neeraj Kumar took away the son of the informant, namely, Bittu Kumar, whereafter accused Munna Kumar fired upon his son which hit his shoulder and petitioner also fired which did not hit him.

It has been submitted on behalf of the petitioner

Patna High Court CR. MISC. No.3691 of 2024(2) dt.30-01-2024 2/2 that the petitioner is in custody since 17-04-2023. Petitioner is stated to be man of clean antecedent.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. There is no direct allegation attributed to the petitioner and other co-accused have been granted bail by Co-ordinate Bench of this Court passed in Cr. Misc. No. 69287 of 2023 & Cr. Misc. No. 1632 of 2024.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, nature of accusation and claim based on parity, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Naubatpur P.S. Case No. 218 of 2023.
