In this case, the petitioners are seeking anticipatory bail in connection with Chanpatiya P.S. Case No. 231 of 2019, registered for the offence under Sections 498(A) and 314/34 of the Indian Penal Code and under Section 3/4 of the Dowry Prohibition Act.
Allegation has been made that the marriage of the informant was solemnized with Ramesh Yadav according to
Patna High Court CR. MISC. No.77160 of 2019(2) dt.27-11-2019 2/3 Hindu law and in the marriage her father gave cash Rs.2,51,000/- to her in-laws. After some time, the informant became pregnant, which was informed by her but, thereafter, all the family members started demanding Rs.1,00,000/- and one bullet motorcycle from the father of the informant. When the demand was no fulfilled, they forcibly administered wrong medicine to the informant, on that account, her pregnancy has been terminated.
Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. He further submits that petitioner no.1 is the brother-inlaw, petitioner no.2 is the mother-in-law, petitioner no.3 is the father-in-law, petitioner no.4 is the sister-in-law and petitioner no.5 is the cousin brother-in-law of the informant. Looking to the entire facts and circumstances of the case, let the petitioners, above named, be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Chanpatiya P.S. Case no.231 of
Patna High Court CR. MISC. No.77160 of 2019(2) dt.27-11-2019 3/3 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
