2. The petitioner seeks bail in connection with Asthawan P.S. Case No. 187 of 2023 registered for the offence under Section 399, 402, 420B of the Indian Penal Code and under Section 25(1-b)a, 26, 35 of the Arms Act.

3. As per the prosecution case, the petitioner and others were caught planning a loot and one country made pistol and two live cartridges have been recovered.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case.

5. It is also submitted by the learned counsel for the petitioner that the petitioner is in jail since 11.9.2023.

6. Learned APP for the State vehemently opposed the prayer of the petitioner for grant of bail.

7. Considering the aforesaid facts, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Cheif Judicial Magistrate, Nalanda in connection with Asthawan P.S. Case No. 187 of 2023.

9. As a condition of this order, the petitioner, after being released on bail is directed to mark his attendance at Laheri Police Station first Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner.
