JUSTICE MOHIT KUMAR SHAH ORAL ORDER 06-09-2022 It is the contention of the learned counsel for the petitioner that the Circle Officer, Patna Sadar, Patna vide order dated 24.3.2011, passed in Encroachment Case No. 10/2010-2011, has found the land in question to have been encroached by the encroachers i.e. the private respondents no. 7 to 9 and have also directed them to remove the encroachment in question, whereafter the

Patna High Court CWJC No.19511 of 2018(2) dt.06-09-2022 2/2 Additional District Magistrate, Law & Order, Patna vide letter dated 25.11.2011 has also directed for deployment of police force for removal of the encroachment in question, but till date, no action has been taken.

Having regard to the facts and circumstances of the case, the petitioner is granted liberty to approach the District Magistrate-cumCollector, Patna for enforcement of the aforesaid order dated 24.3.2011, passed by the Circle Officer, Patna, in case the same has not been annulled by a higher forum / court and in case, appropriate representation is filed within a period of four weeks from today, the District Magistrate, Patna shall make an enquiry into the matter and act, in accordance with law, within a period of twelve weeks, thereafter.

The present writ petition stands disposed of on the aforesaid terms.
