JUSTICE MOHIT KUMAR SHAH ORAL ORDER 24-02-2023 The present writ petition has been filed seeking the following reliefs :- " (i) For directing the respondents to remove the encroachment from the Road/lane, which is a government Land bearing Thana No.

296, Khata-222, Khesra 135 area 0.14 Acre, Muza Tenuaz in District of Rohtas (Sasaram).

(ii) For a direction to the respondent Circle officer to remove the encroachment from the government land, in view of the fact that even

Patna High Court CWJC No.23988 of 2019(3) dt.24-02-2023 2/2 after passing of the final order by the District Magistrate Sasaram in case no. 31/18-19 dated 22.8.19, the Circle Officer is supporting the encroachers who has been found encroachers of Government Land."

At the outset, it has been pointed out that the Circle Officer, Rohtas, Sasaram had passed an order dated 01.10.2019 in Encroachment case no. 31 of 2018-19 and it has been found that the encroachers have encroached the aforesaid government land, which is road/ lane, nonetheless the encroachers have filed an appeal bearing Appeal no. 09 of 2019, before the Collector, Rohtas at Sasaram, however, the same is not being disposed off and is pending since the year 2019.

The learned counsel for the respondent- State submits that the aforesaid appeal would definitely be disposed off within a period of two weeks from today and appropriate action shall be taken, thereafter.

It is directed, accordingly.

The writ petition stands disposed off.
