Petitioner seeks regular bail in connection with Jagdishpur P.S. Case No. 90 of 2019 registered for the offence under Section 419, 420 of the Indian Penal Code. The allegation against the petitioner as per the First Information Report is that the father of the petitioner Shyam Sundar Panjiyar had entered into an agreement with the informant for sale of a piece of land for a total consideration amount of Rs. 300500/-. It has further been alleged that despite having received the consideration amount, sale deed in favour of the informant has not been registered by the father of the petitioner. The petitioner is the witness in the agreement for sale.

Mr. Ranjan Kumar Jha, learned counsel for the petitioner submits that petitioner has unnecessarily been dragged in this case inasmuch as the informant had entered into

Patna High Court CR. MISC. No.75767 of 2019(2) dt.27-11-2019 2/2 an agreement for sale with the father of the petitioner and the father of the petitioner has been granted bail by this court vide Cr. Misc. No. 51938 of 2019 as stated in paragraph no. 12 of this application. Learned counsel further submits that petitioner is in custody since 05.07.2019.

Having heard learned counsel for the parties and taking into consideration the fact that petitioner is a witness in the agreement for sale entered into between the informant and the father of the petitioner has been granted bail by this court, I am inclined to enlarge the petitioner on regular bail. Accordingly, let the petitioner Kumar Saurav @ Mithu be enlarged on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Jagdishpur P.S. Case No. 90 of 2019.
