JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-03-2020 Heard learned counsel for the petitioner and the State. The petitioner, who is a lady, is apprehending arrest in connection with Belhar (Khesar) P.S. Case No. 256 of 2019 for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

In the instant case total 15 litres of illicit liquor was seized.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He further submits that the liquor was seized from the house of this petitioner behind her back.

Considering the fact that the petitioner has got no criminal antecedent and, more so, the recovery was made from her house behind the back, the petitioner named above, in the

Patna High Court CR. MISC. No.76218 of 2019(3) dt.06-03-2020 2/2 event of arrest or surrender before the court below within one month from today, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II, Banka in connection with Belhar (Khesar) P.S. Case No. 256 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
