JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-05-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner is accused in connection with Special POCSO Case No. 57 of 2019 arising out of Karpi P.S. Case No. 172 of 2019, registered under Section 354(B) of the Indian Penal Code and Sections 8 and 12 of the POCSO Act. The accusation is that when the informant, Sangita Kumari, was alone at her house then this petitioner entered and tried to outrage her modesty and tor her cloths with bad intention. When she made protest then then petitioner pressed her mouth and laid down on the ground. On raising alarm, her grandmother came there then petitioner fled away. Learned counsel for the petitioner submits that

No.76727 of 2019(4) dt.28-05-2020 2/2 petitioner and informant are co-villager and due to dirty village politics, the informant lodged the present case with false allegation at the instance of her parents. It is further submitted that petitioner has no criminal antecedent and is in custody since 02.09.2019.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-I-cum-Special Court, POCSO Act, Jehanabad, in connection with Special POCSO Case No. 57 of 2019 arising out of Karpi P.S. Case No. 172 of 2019. Out of two sureties, one surety must be the close relative of the petitioner.
