JUSTICE BIRENDRA KUMAR ORAL ORDER 26-10-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 354 of the Indian Penal Code.

Wife of this petitioner had lodged Jehanabad SC/ST PCase No.28 of 2014 against the husband of the informant and others. After two years of that occurrence, the present FIR was lodged with allegation that the petitioner attempted to outrage the modesty of the informant.

Submission is that after investigation, the police did not send up the petitioner for trial. However, on protest, cognizance has been taken against the petitioner.

No.56894 of 2018 (3) dt.26-10-2018 2/2 Considering the aforesaid material, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Protest-cum-Complaint Case No.92 of 2017 arising out of Jehanabad Mahila P.S.Case No.29 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
